June 15 is the short sale day, Orlando home sellers hoping that it’s True
Fannie Mae and Freddie Mac, the nation’s two largest mortgage backers, will implement their new short sale guidelines on June 15. The changes require mortgage servicers to make a decision within 30 days of receiving a short sale offer. They also must consider requests for pre-approved short sales within that same timeframe.
If the lender needs more than 30 days, it must give borrowers weekly status updates and a decision within 60 days of the initial application. This extension gives lenders more time to determine the value of the property or to get the approval of a mortgage insurer. The moves are aimed at streamlining the short sale process, which often takes months to complete. Faster response times could help thousands of homeowners.
Short sale transactions can get so complicated that many prospective buyers won’t even consider making an offer on a short sale property. And many of those who bid often walk away from the offer because lenders take so long to make a decision. “Short sales are more complex than routine home sales since they may involve multiple parties and long-distance negotiating,” said Tracy Mooney, a Freddie Mac senior vice president. The new rules “are intended to help make the decision process more transparent and timely.”
Banks have also caught on to the benefit of approving short sales. Foreclosures take more time for the bank to recoup their money, and it costs upwards of $50,000 to process a foreclosure. But in the wake of the robo-signing scandal, banks are more apt to help and even encourage a homeowner to pursue via a short sale. In addition to the benefits of the bank, the homeowner comes out much better in the long run. Along with a new home, their credit has been salvaged to a respectable level as opposed to letting a home go due to foreclosure. With a foreclosure it can take up to seven years for your credit to show signs of improvement.

Now free to sign onto Fla. do-not-call list
It’s now free for Floridians to sign onto the state’s Do Not Call program, which protects Floridians from unsolicited phone calls. A resident may add any residential, mobile or paging device to the Florida Do Not Call program.
“Last year, we heard complaints from nearly 20,000 consumers about telemarketing,” says Agriculture Commissioner Adam Putnam. “Now, we’re able to offer protection from unsolicited calls to Floridians at no cost.”
“Realtors are sometimes confused about the do-not-call laws because there is a state program and a federal program,” says Donna Ryan, one of Florida Realtors attorneys. “However, we advise members to check with both the state program and the federal program before making a sales call to a private residence.”
While the Florida program uploads phones numbers to the National Do Not Call Registry, it takes time to do so. A do-not-call phone number could appear on the state list and be subject to Florida fines before it appears on the national list. For businesses, the state do-not-call list costs $120 per area code, per year, or $400 for the entire state.
The Florida Department of Agriculture and Consumer Services maintains the state’s Do Not Call list and updates it quarterly. The 2012 Florida Legislature changed the law to make it a free service for consumers. Previously, Florida residents paid $10 for a new subscription and $5 for renewal. The state will lose over $500,000 by nixing the consumer fee, but it plans to make up for the loss through increased fines charged to people and companies that break the law by calling numbers on the do-not-call list.

Foreclosures take toll on kids
One in 10 U.S. children has been or will be affected by the nation’s surge in foreclosures, a new report says.
Five years into the foreclosure crisis, an estimated 2.3 million children have lived in homes lost to foreclosure, according to a report from First Focus, a Washington, D.C.-based bipartisan advocacy group focused on families.
Another 3 million children live in homes at risk of foreclosure because home loans are in the foreclosure process or are seriously delinquent. And 3 million children lived or live in rental homes lost to foreclosure or at risk, the report says.
“Children are the often invisible victims of the foreclosure crisis,” said report author Julia Isaacs. She did the study while at the Brookings Institution and is now a senior fellow at the Urban Institute’s Labor, Human Services and Population Center.
Isaacs analyzed foreclosure and U.S. Census Bureau data to estimate the number of children affected. The report is the second released by First Focus on the crisis’ impact on children, and the organization says it’s the first to estimate the number of children affected who live in rental properties.
Not surprisingly, the impact on children is greatest in states that were hardest hit by the foreclosure crisis. In Nevada, almost 1 in 5 children lived or live in owner-occupied homes that were lost to foreclosure or are at risk of being lost, Isaacs estimates.
Elsewhere, the percentages fall to 15 percent in Florida, followed by 14 percent for Arizona and 12 percent for California. In Alaska and North Dakota, only 2 percent of children are affected, the lowest rates in the country.
Being forced from home affects children’s health, interrupts development and hurts their performance in school, said First Focus President Bruce Lesley.
For every forced move that occurs during a school year, a child’s math and reading scores drop as much as if they’d missed a month of school, Isaacs says, based on a synthesis of 16 studies.
Isaacs warns that the number of affected children could be even larger. Her estimates are based on mortgage loans made from 2004 to 2008, which captures the bulk of risky loans that contributed to the housing bubble. But it doesn’t cover loans outside of that time. The estimate also fails to adjust for the possibility that loan delinquencies may be higher in families with more children, the report notes.

Freddie Mac sets new short sale timelines, Fannie to follow

Freddie Mac, the federally owned company that buys mortgages from local lenders, says it wants to make the short sale process easier on home sellers by updating its timelines for short sales and requiring better communication from lenders. Last year, Freddie Mac completed 45,623 short sales.
The initiative is part of the Servicing Alignment Initiative (SAI) Freddie Mac and Fannie Mae launched in 2011 at the direction of their regulator, the Federal Housing Finance Agency (FHFA). Yesterday, FHFA announced that Fannie Mae and Freddie Mac must adopt the new short-sale guidelines, and the latter announced compliance shortly after that.
“Freddie Mac’s new timelines are intended to help make the decision process more transparent and timely for short sales under the Obama Administration’s HAFA program or Freddie Mac’s traditional short-sale option,” says Tracy Mooney, Freddie Mac senior vice president, single-family servicing.
Freddie Mac proposals
• Loan servicers should make a decision within 30 days of receiving 1) an offer on a property under Freddie Mac’s traditional short sale program or 2) a completed Borrower Response Package (BRP) requesting consideration for a short sale under HAFA or Freddie Mac’s traditional short sale program. BRPs are standardized assistance applications developed under the Servicing Alignment Initiative.
• If a lender needs more than 30 days, it must give homeowners a status update at least weekly, and a final decision must be made in less than 60 days.
• If a servicer makes a counteroffer, the borrower must respond within five business days. The servicer then has 10 more business days to respond to the buyer.
Freddie Mac says it will use the new timelines to evaluate servicer compliance with the SAI and its own servicing requirements.

Orlando Foreclosure squatters beware
The golden age for foreclosure squatters may soon be coming to an end now that the $26 billion mortgage settlement has been approved.
The settlement, agreed to by the nation’s five largest mortgage lenders, is expected to speed up the foreclosure process by providing stricter guidelines for the banks to follow when repossessing homes. The banks involved include Bank of America, JPMorgan Chase, Citibank, Wells Fargo and Ally Financial. Many foreclosures have been in limbo since fall 2010 following the so-called robo-signing scandal, when banks allowed employees to sign off on thousands of foreclosure documents a month with little verification.
Lenders hit the pause button on foreclosures because they “were afraid that anything they did would be under a microscope,” said Eric Higgins, a professor of business at Kansas State University. As a result, borrowers who were seriously delinquent on their loans have been able to stay in their homes for months or even years without making a single payment. Nationwide, the average time it takes to foreclose on a home — from the first missed payment to the final bank repossession — stretched to 370 days during the first quarter, almost twice as long as it took five years ago, according to Daren Blomquist, the marketing director at RealtyTrac.
In some states, delinquent borrowers have been squatting in their homes much longer. In Florida, the average time was
861 days, and in New York it was 1,056 days — close to three years. “Perhaps a million foreclosures could have been pursued last year but weren’t,” said Rick Sharga, executive vice president for real estate investment company, Carrington Holdings. But that’s all about to change, he said. “We’re going to see an increase in the speed of foreclosures and a higher number of foreclosure starts.” In fact, there are indications that the pace of foreclosures are already starting to pick up.
While overall foreclosure activity was down during the first quarter, filings were up 10% in the 26 states where foreclosures must undergo court scrutiny, according to RealtyTrac. It was in these judicial states that the processing of foreclosures slowed the most following news of the robo-signing scandal, said Blomquist. Many banks in these states stopped filing foreclosures unless they were extremely confident it would pass muster in the court. (In non-judicial states, foreclosures are reviewed by a trustee, which is a third party such as a title company and less likely to parse every legal document). But now lenders can move more confidently, said Brandon Moore, RealtyTrac’s CEO.
In the judicial state of Indiana, for example, foreclosure filings were up 45% year-over year. And in Florida, they were up by almost 26%, according to RealtyTrac. “The dam may not burst in the next 30 to 45 days, but it will eventually burst, and everyone downstream should be prepared for that to happen — both in terms of new foreclosure activity and new short sale activity,” Moore said in a statement. The resulting flood could bring home prices down even further — yet another impetus for the banks to clear out their foreclosure pipeline as quickly as possible, said Kansas State’s Higgins. Then, industry thinking is, the housing market would be able to get back to normal and home prices could eventually find their true value. Some industry analysts, such as the chief economist for listing site Zillow, Stan Humphries, are predicting that could happen as soon as the end of the year. Zillow estimates that home values nationwide will fall another 3.7% by the end of 2012, and that price will likely bottom out by early 2013. Should home prices hit a bottom then stabilize, it would push many potential buyers off the fence, according to Mike Fratantoni, a vice president at the Mortgage Bankers Association. House hunters would no longer be afraid of investing in assets that were losing money. “The market is already on the verge of turning the corner on prices and this will help,” said Fratantoni.

FHA fees increase today, Orlando Real Estate buyers take notice

The upfront insurance premium charged on FHA-insured mortgages for home purchases increased from 1 percent to 1.75 percent today, and annual FHA mortgage insurance premiums rose by one-tenth of a percentage point.
For homebuyers, that means the cost of a $200,000 FHA mortgage rose by about $24 a month, assuming the borrower includes the upfront charge in the amount financed through a 30-year mortgage.
Jumbo loans did not change today, but a fee increase for jumbo loans and some 15-year loans will be added June 11.
While homebuyers won’t enjoy the extra cost, the U.S. Department of Housing and Urban Development says the extra income generated by the fee increase – the fourth one in three years – should generate more than $1 billion by 2013.

CoreLogic released its February Home Price Index (HPI) report, the most current and comprehensive source of home prices available today. Excluding distressed sales, month-over-month prices increased 0.7% in February from January. The CoreLogic HPI also showed that year-over-year prices declined by 0.8% in February 2012 compared to February 2011. Distressed sales include short sales and real estate owned (REO) transactions. The report also shows national home prices, including distressed sales, declined on a year-over-year basis by 2.0% in February 2012 and by 0.8% compared to January 2012, the seventh consecutive monthly decline.
Highlights as of February 2012:
- Including distressed sales, the five states with the highest appreciation were: West Virginia (+8.6%), Michigan (+5.8%), Florida (+4.7%), Arizona (+4.5%) and South Dakota (+4.1%).
- Including distressed sales, the five states with the greatest depreciation were: Delaware (-11.2%), Connecticut (-7.9%), Rhode Island (-7.8%), Illinois (-7.1%) and Georgia (-6.6%).
- Excluding distressed sales, the five states with the highest appreciation were: South Dakota (+5.9%), West Virginia (+5.6%), Maine (+4.5%), Utah (+3.7%) and Montana (+3.6%).
- Excluding distressed sales, the five states with the greatest depreciation were: Delaware (-8.7%), Connecticut (-4.9%), Nevada (-4.6%), Vermont (-4.0%) and Minnesota (-3.3%).
- Including distressed transactions, the peak-to-current change in the national HPI (from April 2006 to February 2012) was -34.4%. Excluding distressed transactions, the peak-to-current change in the HPI for the same period was -24.6%.
- The five states with the largest peak-to-current declines including distressed transactions are Nevada (-60.2%), Arizona (-49.8%), Florida (-48.6%), Michigan (-44.0%) and California (-43.7%).
- Of the top 100 Core Based Statistical Areas (CBSAs) measured by population, 67 are showing year-over-year declines in February, nine fewer than in January.
